Chapter 1 Overview
Article 1 [Purpose of the Rules]
In order to provide users with a higher quality, safer, and more reliable commercial environment and transaction experience, promote the integration of online and offline collaborative governance, and optimize the HuoPan platform ecosystem (including the HuoPan website and client), these general rules are formulated.
Article 2 [Basis of the Rules]
(1) [Legal Basis]
The "E-Commerce Law of the People's Republic of China," the "Cybersecurity Law of the People's Republic of China," the "Consumer Rights Protection Law of the People's Republic of China," the "Measures for the Supervision and Administration of Online Transactions," and other national laws and regulations and related normative documents (hereinafter referred to as "legal provisions") set forth the legal rights and obligations of all parties in the HuoPan platform ecosystem and serve as the legal basis for the formulation and revision of HuoPan platform rules.
(2) [Normative Basis]
The relevant agreements of the HuoPan platform, as legal documents clarifying the rights and obligations between HuoPan and its members, serve as the normative basis for the platform's rules.
(3) [Philosophical Basis] The parties in the HuoPan platform ecosystem practice business ethics and social responsibility, co-exist and win-win, co-govern and co-build on the platform. They self-regulate and develop in a standardized manner, maximizing the interests of all parties through beneficial exploration when the law does not provide clear regulations. This is the philosophical basis for the rules of the HuoPan platform.
Article 3 [Principles of the Rules]
All parties in the HuoPan platform ecosystem respect and adhere to the following principles: equality, voluntariness, fairness, and integrity. The actions of all parties on the HuoPan platform must not violate legal provisions or public order and good customs.
Article 4 [Applicable Objects]
The rules of the HuoPan platform apply to all parties in the HuoPan platform ecosystem, including users, members, buyers, sellers, other relevant stakeholders, and HuoPan itself.
Article 5 [Rule System and Effectiveness]
The rule system and effectiveness levels of the HuoPan platform are as follows:
(1) [Rule System] The rules of the HuoPan platform are the general term for the following rules:
1. "General Rules of HuoPan Platform" (hereinafter referred to as "the General Rules");
2. Specific rules and regulations formulated for HuoPan platform membership market management, violation handling, industry market management, marketing activities, and other necessary matters, including the corresponding implementation details for further refinement of specific rules (hereinafter referred to as "normative regulations");
3. Temporary announcements issued by HuoPan platform according to temporary management needs.
(2) [Effectiveness Levels] The provisions in the "General Rules" are followed where applicable; specific provisions in the rules or temporary announcements take precedence over general provisions. Where the HuoPan platform rules do not provide specific guidelines, HuoPan will handle matters in accordance with legal provisions or related agreements.
Article 6 [Rule Procedures]
HuoPan, based on national legal requirements and the development needs of the ecosystem, will prudently formulate or modify the platform rules as necessary, and make the rules public on the HuoPan platform rules page. The rules will take effect from the expiration of the public notice period.
The formulation or modification of transaction rules will follow a public opinion solicitation procedure according to law and will be reported to the relevant functional departments.
Article 7 [Retroactive Effect of the Rules]
Actions that occurred before the rules took effect will be governed by the rules in place at the time; actions that occur after the rules take effect will be governed by the new rules.
Chapter 2 General Provisions for Members
Article 8 [General Principles]
Members must comply with national laws, HuoPan platform rules, and follow the instructions provided on relevant HuoPan platform pages when engaging in any activity.
Article 9 [Registration]
Members must complete the registration process in accordance with the HuoPan platform's procedures and requirements. Once registered, a member's username can only be modified once per year.
Members may link their membership account to an Alipay account and may change the linked Alipay account if certain conditions are met.
If a member's account is inactive, HuoPan may reclaim it.
Article 10 [Certification]
Members must provide authentic and valid information as per HuoPan platform's certification requirements (for natural persons, legal persons, and non-legal persons, etc.).
(1) The information provided by members must include, but is not limited to, identity information, personal information, valid contact details, real address, business address, market entity registration information, Alipay information, and other required certification details to verify the authenticity, validity, and consistency of the identity. If the provided information is incomplete, outdated, or inaccurate, HuoPan may reject the certification.
(2) To ensure the continued authenticity and validity of the certified information, HuoPan may conduct a re-examination of the member's certification details.
Article 11 [Information Posting]
Members are prohibited from posting the following information:
(1) Opposes the basic principles set forth in the Constitution;
(2) Endangers national security, discloses state secrets, subverts the government, or undermines national unity;
(3) Damages the honor and interests of the nation;
(4) Distorts, vilifies, desecrates, or denies the deeds and spirit of heroes and martyrs, insults, defames, or otherwise infringes upon the names, portraits, reputations, or honors of heroes and martyrs;
(5) Promotes terrorism, extremism, or incites terrorist activities or extremist activities;
(6) Incites ethnic hatred, ethnic discrimination, or undermines national unity;
(7) Undermines national religious policies, promotes cults, or superstitions;
(8) Spreads rumors, disrupts economic and social order, or undermines social stability;
(9) Spreads obscenity, pornography, gambling, violence, murder, terrorism, or incites crime;
(10) Insults or defames others, infringing upon others' legitimate rights;
(11) Fraudulent, false, inaccurate, or misleading information;
(12) Other information that violates legal provisions, social morality, or is unsuitable for posting on the HuoPan platform according to the platform's agreements.
Article 12 [Transactions]
Members must follow the HuoPan platform's transaction process to conduct genuine transactions.
Article 13 [Evaluation]
Members should reasonably use HuoPan platform’s evaluation tools. Those using the HuoPan evaluation tool must follow the HuoPan evaluation standards, and those using other platform evaluation tools must comply with the corresponding regulations.
Chapter 3 Seller Regulations
Section 1 HuoPan Website Seller Regulations
Article 14 [Store Opening and Withdrawal]
Members must adhere to the following requirements when opening or withdrawing a store on the HuoPan website:
(1) Opening a Store: A member can create a store after meeting the related criteria and following HuoPan's process. Under normal circumstances, a member can only open one store as a seller. Honest sellers who meet certain operational criteria may open multiple stores.
(2) Store Information Setup: Sellers must ensure that store names, domains, logos, and descriptions comply with legal regulations.
(3) Change of Store Operating Entity: Sellers may change the operating entity of the store under certain conditions.
(4) Store Withdrawal: When a seller voluntarily cancels a store or HuoPan platform terminates, closes, or freezes the store, the store name and domain may be used by other sellers.
Article 15 [Deposit]
Sellers must deposit a guarantee to ensure the fulfillment of consumer protection service commitments and the compliance with HuoPan platform agreements and rules.
Article 16 [Qualification Filing]
When publishing products or services that require qualification, sellers must submit qualification materials for review and filing according to the rules and system settings of HuoPan platform.
Article 17 [Information and Quality]
Product or service information published by sellers must comply with legal regulations.
Sellers must ensure that their products or services are usable within a reasonable period, meet the performance specifications and packaging requirements, and pose no risk to personal or property safety, and are responsible for the quality of the products or services they sell.
Sellers must ensure that material descriptions of their products comply with legal provisions. HuoPan platform may conduct random checks on products or services sold by sellers.
Article 18 [Transaction Fulfillment and Service Guarantee]
Members can choose the transaction method according to HuoPan platform's requirements and actual needs.
Sellers must fulfill their transaction or service commitments, including timely delivery within the specified or promised period (unless in special circumstances).
Sellers must protect the legal rights of buyers, provide consumer protection services, and comply with the "Consumer Rights Protection Law of the People's Republic of China" and other related regulations.
Article 19 [Marketing]
Sellers participating in HuoPan platform marketing activities must comply with the corresponding marketing rules and related regulations.
Chapter 4 Supplementary Provisions
Article 20 These rules came into effect on November 7, 2024.
Article 21 The term "above" in the HuoPan platform rules includes the number mentioned; the term "below" does not include the number mentioned.
Article 30 The term "day" in the HuoPan platform rules is calculated as 24 hours.
Appendix Definitions
1. User refers to any individual who uses the services of the HuoPan platform. Users do not need to register to browse related information on the platform.
2. Member refers to a user who has signed a service agreement with HuoPan and completed the registration process, including natural persons, legal persons, and non-legal organizations as equal civil entities.
3. Buyer refers to a member who purchases products or services on the HuoPan platform.
4. Seller refers to a member who successfully creates a store on the HuoPan platform and engages in selling products or providing services.
5. Other relevant stakeholders refer to individuals or organizations with a certain relationship with HuoPan platform users, such as intellectual property rights holders, service market users, content creators, and institutions.
6. HuoPan refers to the operator of the HuoPan platform, including HuoPan Network operator Shenzhen HuoPan E-Commerce Co., Ltd.
7. Intellectual Property Rights Holder refers to a natural person, legal person, or organization that lawfully owns trademark rights, copyright, patent rights, and other intellectual property rights.
